In one case involving arbitration of an oil and gas lease executed by an individual lessor and a corporate lessee, the lessee had invested a sizable amount of money to develop three producing natural gas wells. The lessor had been accepting substantial royalty payments but after a period of time when there had been no activity to develop additional wells, the lessor claimed the lease had expired. It was determined that the lease had not expired so as to prevent the lessor from renegotiating the lease.
In another interesting case the plaintiff sued to enjoin the defendants from using material and knowledge gained while defendants worked for plaintiff as top level employees in order to keep defendants from competing with plaintiff in the design of flocked poster art. The case involved a segment of the market for children’s arts and crafts products, specifically flocked posters. Basically, this was an intellectual property case.
After thorough discussions, offers of proof, testimony, etc. Judge Rosenbaum managed to mediate the case to a settlement. In a case involving injuries to a person who was knocked off a ladder when a wall fell on him there were complex issues, exacerbated by the fact that plaintiff was involved in an automobile accident three months after the wall incident. The wall was under the control of the defendant at the time. Issues involving permancy, life expectancy, mobility and degree of disability were evaluated in this arbitration and the case was ultimately settled at the direction of the arbitrator.
